Welcome to Calmbination (referred to as “we,” “us,” or “our”). By accessing or using our website at calmbination.com and purchasing our branded clothing, downloadable documents, or in-person class registrations, you agree to be bound by the following Terms of Service and Sale (“Terms”).
Please read these Terms carefully before placing an order, downloading files, or registering for a class.
1. general conditions & account eligibility
- Age requirement: By agreeing to these Terms, you represent that you are at least the age of majority in your state, province, or country of residence.
- Acceptance: If you do not agree to all terms and conditions of this agreement, you may not access the website, purchase physical or digital products, or register for our classes.
- Modifications: We reserve the right to update, change, or replace any part of these Terms by posting updates to our website. It is your responsibility to check this page periodically for changes.
2. products, classes & pricing
- Product & event descriptions: We make every effort to accurately display the colors, features, descriptions, and schedules of our physical merchandise, digital downloads, and in-person classes. However, we cannot guarantee that your device's display will reflect exact colors, or that class schedules will never require emergency adjustment.
- Price changes: Prices for all merchandise, digital files, and class registrations are subject to change without notice. We reserve the right to modify or discontinue any item or service at any time.
- Pricing errors: In the event a product or class registration is listed at an incorrect price due to a system or typographical error, we reserve the right to cancel or refuse any orders placed for that item.
3. intellectual property rights
- Branded merchandise & content: All clothing designs, brand names, logos, graphics, website content, and course materials associated with Calmbination are our exclusive property and are protected by applicable intellectual property laws.
- Downloadable documents: When you purchase a digital document or downloadable file from us, you are granted a single-user, non-exclusive, non-transferable license for personal, non-commercial use only. You may not resell, redistribute, share, modify, re-license, or claim ownership of any digital content purchased from Calmbination.
4. refund, cancellation & transfer policies
Because Calmbination provides physical goods, digital downloads, and live in-person classes, distinct return, cancellation, and refund rules apply to each category.
4.1 Physical goods (branded clothing)
- Return window: You have 30 days from the date of delivery to request a return or exchange.
- Condition: Items must be unworn, unwashed, unused, and in original condition with all tags attached.
- Return shipping: Customers are responsible for paying return shipping costs unless the item arrived damaged, defective, or was sent in error.
- Processing: Once approved, refunds will be credited back to your original payment method within 5–10 business days.
4.2 Digital goods (downloadable documents)
- Final sale: Due to the immediate delivery and non-returnable nature of digital files, all digital document sales are final and non-refundable once downloaded or accessed.
- Exceptions: If you experience technical errors preventing file downloads, or accidentally purchase duplicate copies in a single transaction, contact us within 7 days for assistance or refund evaluation.
4.3 In-person classes
Attendee cancellations & refunds
- 7+ days notice: Cancellations requested at least 7 calendar days prior to the class start date receive a 100% refund (minus non-refundable payment processing fees).
- 3 to 6 days notice: Cancellations requested 3 to 6 days prior to the class start date receive a 50% refund or full store credit.
- Under 72 hours notice / no-shows: Cancellations made within 72 hours of class start time, as well as unannounced non-attendance, are non-refundable.
Transfers & ticket substitutions
- Date rescheduling: You may request to transfer your registration to a future class date at no cost if requested at least 48 hours prior to the class start time (subject to seat availability).
- Seat substitutions: You may assign your ticket to another person up to 24 hours prior to the class by notifying us with the new attendee's full name and email address.
Host-initiated cancellations & rescheduling
- Calmbination reserves the right to cancel or reschedule classes due to low enrollment, instructor illness, venue disruptions, or severe weather.
- Registered attendees will be notified via email at least 24 to 48 hours before the scheduled start time when possible.
- If we cancel a class, you may select: (1) a full 100% refund, (2) automatic transfer to the rescheduled class date, or (3) store credit for physical products, digital downloads, or future classes.
On-site guidelines
- Please arrive 10–15 minutes early. Late arrivals beyond 15 minutes may be denied entry to prevent class disruption, without refund eligibility.
- Calmbination reserves the right to remove any participant without a refund if their conduct is disruptive, unsafe, or inappropriate.
4.4 Damaged or defective deliverables
If you receive damaged or defective physical merchandise, or a corrupted digital file, contact us within 7 days with your order number and a photo or description of the issue for a prompt replacement or refund.
5. prohibited uses
In addition to other restrictions in these Terms, you are strictly prohibited from using the site or its content:
- For any unlawful purpose or to solicit others to perform unlawful acts.
- To infringe upon or violate our intellectual property rights or the rights of others.
- To upload viruses, malware, or malicious code.
- To duplicate, re-sell, or exploit any portion of our digital documents, clothing designs, or class materials without express written permission.
6. limitation of liability
To the fullest extent permitted by law, Calmbination shall not be liable for any direct, indirect, incidental, punitive, or consequential damages arising from your use of our website, physical products, digital downloads, or attendance at our in-person classes. Our total liability for any claim arising out of these Terms shall not exceed the total amount paid by you for the specific product or class registration in question.
7. governing law
These Terms of Service and any separate agreements for goods or services shall be governed by and construed in accordance with the laws of the State of North Carolina, with venue in Charlotte, North Carolina.
